TypePup Terms of Service

1. Agreement Overview

These Terms of Service ("Terms") are a legal agreement between you and the individual developer who operates TypePup ("we," "us," or "our"). By accessing or using TypePup at typepup.com, you agree to be bound by these Terms.

How you accept these Terms:

• By using TypePup, you confirm you have read and agree to these Terms
• If you are a parent or guardian, you accept on behalf of your child
• If you make a purchase, you also accept by completing that transaction
• If you do not agree, please do not use TypePup

2. What is TypePup?

TypePup is a free educational Progressive Web App (PWA) designed to help young children learn their letters and numbers through typing practice.

Core Features (Always Free)

• Letter recognition and typing practice (A-Z)
• Progress tracking with stars and badges
• Multiple child profiles on one device
• Voice pronunciation using your browser's speech system
• English and Hungarian language support
• Offline functionality (works without internet)

Optional Premium Features

• Numbers Mode (€2.99) - Practice typing 0-9
• Phonics Mode (€3.99) - Learn letter sounds
• Theme Pack (€1.99) - Additional visual themes
• Printable Worksheets (€2.99 each) - PDF downloads for offline practice

How TypePup Works

• Web-based: Runs in your browser (Chrome, Safari, Firefox, Edge)
• Installable: Can be added to your home screen like an app
• Local storage: All data stays on your device
• No accounts: No registration, login, or passwords required
• No tracking: No analytics, cookies, or behavioral tracking

3. Who Can Use TypePup

For Children (Ages 3-7)

• Children may use TypePup's educational features
• Parental or guardian supervision is expected
• Children should NOT access payment or shop features
• We use "parent gates" (simple math questions) to protect shop access

For Adults (Ages 18+)

• Adults may use TypePup for any lawful purpose
• Only adults may make purchases or donations
• Parents/guardians are responsible for their child's use
• Adults handle all communication with us

Parent Gate System

Before accessing the shop or purchase features, users must solve a simple math problem (like "What is 7 + 5?"). This helps ensure an adult is present for any purchase decisions. This is not a foolproof security measure, and parents should supervise their children.

4. Acceptable Use

When using TypePup, you agree to:

Use TypePup For

• Educational purposes for yourself or your children
• Personal, non-commercial use
• Learning letters, numbers, and typing skills

Do NOT

• Redistribute, sell, or commercially exploit TypePup
• Reverse engineer, decompile, or attempt to extract source code
• Circumvent or help children bypass parent gate protections
• Use TypePup for any illegal purpose
• Attempt to harm, overload, or disrupt the service
• Misrepresent your relationship with TypePup

5. Intellectual Property

What We Own

• The TypePup name, logo, and branding
• All original content, artwork, and animations
• The application code and design
• Printable worksheet designs

What You Own

• Your child's profile names and custom settings
• Progress data stored on your device
• Downloaded PDF worksheets (for personal use)

License to Use

We grant you a limited, non-exclusive, non-transferable license to use TypePup for personal, non-commercial educational purposes. This license does not transfer any ownership rights to you.

Open Source Components

TypePup may include open-source software components, which retain their original licenses. These components are used in compliance with their respective licenses.

6. Purchases & Payments

What Happens When You Purchase

1. You click a purchase link in TypePup
2. You're taken to Ko-fi's secure checkout page
3. You complete payment through Ko-fi/Stripe
4. For content packs: Return to TypePup and click "I've purchased" to unlock
5. For worksheets: Download your PDF directly from Ko-fi

Honor-Based Unlock System

TypePup uses an honor-based system for unlocking content packs. After purchasing on Ko-fi, you manually unlock the feature in the app. We trust our users to be honest. This system exists because TypePup has no server infrastructure to verify purchases automatically.

Pricing

• All prices are displayed in Euros (€)
• Prices may change with reasonable notice
• If you purchased at a previous price, you keep that price
• Your bank may apply currency conversion fees

Important: Ko-fi Is Not a Party to This Agreement

Ko-fi provides the payment platform but is not responsible for:

• Refund processing (we handle this directly)
• Content delivery disputes
• Customer service for TypePup purchases

7. Refund Policy

How to Request a Refund

1. Email [email protected] with "Refund Request" in the subject
2. Include: Your Ko-fi account email, approximate date, and amount
3. We aim to process refunds within 5 business days
4. Refunds are issued via your original payment method

What's Covered

• Content pack purchases (Numbers, Phonics, Themes)
• Printable worksheet bundles
• Voluntary Ko-fi donations/tips

Important Notes

• Ko-fi cannot process refunds - only we can
• After a refund, please disable unlocked features in good faith
• We may ask for feedback (optional) to improve TypePup

8. Disclaimers

We want to be upfront about what TypePup is and isn't:

TypePup Is

• A supplementary educational tool
• A fun way to practice letter and number recognition
• Designed to support (not replace) other learning

TypePup Is NOT

• A substitute for professional education or therapy
• A medical or developmental diagnostic tool
• Guaranteed to produce specific learning outcomes
• A replacement for parental involvement in learning

"As Is" Service

TypePup is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The service will be uninterrupted or error-free
• Defects will be corrected immediately
• The service will be compatible with all devices

However, we actively maintain TypePup and address issues as they arise. We care about quality, even without formal warranties.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

Maximum Liability

Our total liability to you for any claims arising from your use of TypePup shall not exceed the greater of: (a) the amount you paid to us in the past 12 months, or (b) €50.

We Are Not Liable For

• Indirect, incidental, or consequential damages
• Lost data due to device issues or browser storage clearing
• Device performance or compatibility issues
• Third-party service disruptions (Ko-fi, Stripe, browser providers)
• Issues arising from your internet connection

Exceptions

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded by applicable law

10. EU Consumer Rights

14-Day Right of Withdrawal

Under EU law, you normally have 14 days to withdraw from a digital content purchase without giving any reason. However:

• For downloadable PDFs: By downloading the file, you acknowledge that the digital content has been fully delivered and you expressly consent to lose your right of withdrawal upon download.
• For content packs: By unlocking a feature, you acknowledge immediate access and expressly consent to lose your right of withdrawal for that purchase.

Even so: Our 180-day refund policy goes far beyond the 14-day minimum. If you're unhappy for any reason, contact us.

How to Exercise Withdrawal (If Applicable)

If you haven't downloaded or unlocked your purchase, you may withdraw by:

1. Emailing [email protected]
2. Clearly stating your wish to withdraw
3. Including your purchase details and date

Other EU Consumer Rights

• These Terms do not affect your statutory rights
• Unfair contract terms are not binding on you
• You may seek remedies under your local consumer laws

11. Dispute Resolution

We hope you never have a problem with TypePup, but if you do:

Step 1: Contact Us First

Most issues can be resolved quickly through direct communication. Email us at [email protected] and we'll do our best to help within 48-72 hours.

Step 2: Informal Resolution

Before pursuing formal action, we ask that you give us 30 days to resolve your concern informally. This benefits everyone by avoiding unnecessary legal costs.

Step 3: Formal Options

• EU Consumers: You may use the EU Online Dispute Resolution platform
• All Users: You may pursue remedies available under your local laws

Governing Law

These Terms are governed by the laws of Hungary, without regard to conflict of law provisions. However, if you are a consumer in the EU, you also benefit from any mandatory consumer protection provisions of your country of residence.

No Mandatory Arbitration

We do not require mandatory arbitration. You retain your right to pursue claims in court.

12. Termination

You Can Stop Anytime

• Simply stop using TypePup - no action required
• Delete your browser data to remove all local information
• Uninstall the PWA from your device if installed

We May Modify or Discontinue

We reserve the right to:

• Modify TypePup's features with reasonable notice
• Temporarily suspend the service for maintenance
• Discontinue the service entirely (with 60 days notice if possible)

If we discontinue TypePup, we will:

• Provide as much notice as reasonably possible
• Offer refunds for any recent purchases (within 90 days)
• Make downloadable content available for a transition period

Your Data After Termination

Since all data is stored locally on your device, you always have control. We don't have server-side data to delete. See our Privacy Policy for instructions on clearing local data.

13. Changes to Terms

How We Update These Terms

• We may update these Terms from time to time
• Material changes will be posted at least 30 days before taking effect
• The current version is always available at typepup.com/terms
• The "Last Updated" date at the top indicates the most recent changes

Your Options

• Continued use after changes means you accept the new Terms
• If you don't agree, stop using TypePup before the changes take effect
• Material changes don't affect purchases made under previous Terms
